Terms of Service

1. Acceptance of Terms

These Terms of Service form an agreement between you and AguilarTech, the Australian company that operates WombatLink ("we", "us", "our"). By creating an account, signing in, or using any part of the WombatLink service, you agree to these Terms. If you don't agree, please don't use the service.

2. Description of Service

WombatLink is a web-based tool for tour guides. As a guide, you can create a pickup link that contains the meeting location, photos of the spot, an itinerary, and a contact number. You share the link with your guests, and when they open it they can view those details on a map and chat with you in real time. We may translate itinerary text into the guest's chosen language to make the experience easier for both sides.

3. User Accounts

You can create an account using your email and a password, or by signing in with Google. By using the service you agree to:

  • Provide accurate, current, and complete information when registering.
  • Keep your login credentials secret. You are responsible for everything that happens under your account.
  • Use one account per person. Sharing an account between multiple guides isn't allowed.
  • Tell us promptly if you suspect someone else has accessed your account.

We may suspend or close accounts that are used to abuse the service or other users.

4. Acceptable Use

You agree not to use WombatLink to:

  • Break any law or regulation in your country or the country of your guests.
  • Harass, threaten, or harm other users (whether guides, guests, or our staff).
  • Send spam or unsolicited commercial messages through the chat or any other channel.
  • Upload content you don't have the right to share, or that is illegal, obscene, or hateful.
  • Scrape, copy, reverse engineer, or otherwise misuse the service or its data.
  • Try to disrupt the service, get around access controls, or probe for vulnerabilities without our written permission.

5. Your Content

You keep ownership of the photos, itinerary text, and other content you upload to WombatLink ("Your Content"). By uploading Your Content, you grant us a worldwide, royalty-free, non-exclusive licence to host, store, display, copy, and (where you have requested translation) translate that content for the purpose of running the service for you and showing it to the guests you share your links with. This licence ends when you delete the content or your account, except for copies that may persist briefly in routine backups.

You're responsible for making sure you have the right to upload Your Content, including any photos that show other people or places.

6. Free Trial and Paid Plans

New accounts get a 30-day free trial of WombatLink. We plan to launch a paid plan within 30 days of public release. When the paid plan goes live, we'll publish pricing and plan details, give you advance notice before charging anything, and give you the chance to decide whether to continue.

Anonymous users (who haven't signed up) can create a small number of free links so they can try the product before creating an account.

7. Termination

You can delete your account at any time from your account settings or by emailing us. When you do, we'll remove your personal data and the pickup links tied to your account in line with our Privacy Policy.

We may suspend or terminate your access if you breach these Terms, abuse the service, or put other users at risk. Where it's reasonable to do so, we'll let you know first.

8. Disclaimers

WombatLink is provided on an "as is" and "as available" basis. We don't make any warranty that the service will always be available, error-free, or fit for any particular purpose, beyond what we cannot exclude under the Australian Consumer Law.

WombatLink is a communications tool, not a guaranteed dispatch system. Network outages, device problems, or third-party failures can delay messages and map updates. Tour guides should always have a backup way to reach their guests (such as a phone number or meeting time confirmed in advance) and should not rely on WombatLink as the sole channel for time-sensitive pickups.

9. Limitation of Liability

To the maximum extent permitted by law, AguilarTech and its officers, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost bookings, lost data, or loss of goodwill, arising out of your use of WombatLink.

Where liability cannot be excluded but can be limited, our total liability to you for all claims in any 12-month period is capped at the greater of (a) the fees you paid us during the 12 months before the event giving rise to the claim, or (b) AUD $100 if you are a free user.

Nothing in these Terms limits any rights you have under the Australian Consumer Law that cannot be limited or excluded.

10. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. You and AguilarTech submit to the non-exclusive jurisdiction of the courts of Victoria for any dispute arising out of or relating to these Terms or the service.

11. Changes to These Terms

We may update these Terms from time to time. If a change is material, we'll let you know by email or in the app and update the effective date at the top of this page. Your continued use of WombatLink after the change takes effect means you accept the new Terms.
